Leadership Assessment

Leadership Assessment Leadership is defined as the process of influencing others to understand and agree about what needs to be done and how to do it, in order to accomplish what you set out to do. People often assume that anyone in a management position is a leader but I find that statement to be false. To be considered a leader, you must have very strong beliefs, and to work hard at your goal and stay focused. A Chief Executive Officer (CEO) is the highest ranked executive manager in a corporation and in my opinion one of the most important.A CEO can range from being the founder of a company, the owner of a business, or they have a great significance within the corporation. A CEO’s responsibility can vary depending on how involved he or she is within the corporation. Although there are many tasks at hand in which a CEO bears, such roles can include significant responsibility, accountability, and authority within the organization. CEO is also response for making sure that the vision, mission and overall direction is being followed through properly.Demonstrating these roles is vital to make sure that the organization’s mission is successful. At my previous employer, I worked for a company call Florida Light and Power (FPL) and although I only met our CEO on a few occasion his name was Armando J. Olivera, and his leadership style impacted me greatly. Mr. Olivera’s leadership style was charismatic style and he did it very well. He was always known as a person who had such an enthusiasm attitude and was always positive minded. Mr. Olivera always wanted to give back to people and teach people something new (Salisbury, 2011).His attitude made me want to come to work each day. Mr. Olivera started with the company with back in 1972 as an engineer trainee and became the CEO back in 2003. The CEO would always adhere to the standards and rules and he really set an example of how he expected his employees to act. He always projected himself in a busin esslike manner, and conformed to the rules. He was never the type of person to leave early just because he was the CEO or to take holidays off while the rest of the employees worked.He personally impacted me in a positive manner when I first started. The training period is an intention training that involves several classes that included videos to watch, and during those videos Mr. Olivera was actually in the videos speaking and explaining his vision and what he expects and his story of how he started out. The story really made me look at the company differently and because Mr. Olivera was all about how to make the customer happy and the great lengths that he would endear to make sure that that happened.In order to ensure that FPL employees were always on the right path the CEO would produce training videos for team development that displayed such qualities like integrity, drive, consideration, and self confidence. The CEO always made sure that his expectation was made to be clear a nd the vision and mission statements were followed through properly. FPL vision statement states as followed â€Å"we will be the preferred provider of safe, reliable, cost-effective products and services that satisfy the electricity related needs of all our customer segments† (â€Å"Fpls commitment to,†).Divisional structure was the type of organization structure at FPL. Since FPL was such a large company with over 10,000 employees in the state of Florida, we operated in a wide geographic area and targeted difference areas with difference specialized groups. This was a huge advantage to our company because it helps meet more rapid demands and is able to handle a larger division. This also helped the company move into other forms of energy sources that they could provide to customers. Within the organizational structure at FPL there are levels of hierarchy that distribute the responsibility within the organization.Divisional structure at FPL allows common culture to bu ild and contribute to a higher and better knowledge of the company and its services. (Gillikin) Ethical conduct refers to an organizations moral standards concerning the action of individual members and also the decisions of the organization as a whole. At FPL the CEO has placed this responsibility on to Human Resources to ensure that all employees were following the code of conduct and conducting themselves in the upmost professional manner; no employees including the CEO were exempted from this.As their ethical practices have become an economical benefit for the company, it also prevents disrespectful behavior, bullying between coworkers, prevention between personal phone calls at the companies expense, improper use of company equipment, and excessive sick days etc. The code of ethical conduct has greatly effected the way business is properly conducted. FPL strives to not only do the legal thing but the ethical thing as well in order to ensure our customers with satisfactorily ser vice.FPL has a public image to obtain as they are the largest energy provider in the state of Florida. Also unethical business can not only hurt a companies reputation, but it can prevent prospective employees from choosing to work for FPL. (Vossos) There are many ways to motivate employees, and may different techniques that seem to work better than others. First off the most motivating thing in the work place is money, so offering employees bonuses for reaching a mark or being the leader in sales with a nice bonus will encourage all the employees to work harder and better for the extra money.Many large companies do this to motivate such as google and Microsoft use this technique. Another way to motivate is offer extra time off or paid time off for the employee that has preformed the best for each quarter. The third way to motivate employees would to add some perks for them while they are at work such as child daycare or pay for any food they might want or have free drink machines. These are just a few ways to make the work space more enjoyable and move appealing for employees.The Hawthorne studies in the early nineteenth century examined and studied how managers can motivate employees to work more efficiently, with quality work at the maximum rate of return. One of the areas of information derived from the Hawthorne studies was that something more than pay incentives was improving the employees’ output within work groups. Researchers found that there was improvement in the work due to the fact that employees felt important because someone was studying them at work.One of the concepts that leaders can derive from this historic discovery is that leaders must find ways to motivate and reward their employees besides the perceived rewards of being employed and having a pay incentive. (Cook) Companies today are faced with a host of issues, which may cripple their functionality, or in some extreme cases render the organizations obsolete. For example Kodak onc e a leader and innovator in the photo industry but they fell behind and had to file for bankruptcy.These challenges are dependent on the nature of operations of the company, these challenges face a large amount of different organizations. Technological advancements today are on the increase more than in the previous century. Technology changing creates a problem for businesses because when technology changes the company has to stay up to date with the technology so they would have to teach all there employees how to run the new programs and buying the new technology can be very costly.Another problem companies face generational gaps have created a difficulty in determining consumer behaviors, yet most companies are investing heavily in customer behavior analysis to determine the most appropriate way of matching a customers’ needs. Once again times change and so do customers taste and opinions change and businesses need to stay current with the changes if not they will end up like Kodak. A problem that we can all relate to as of lately is unstable economies and currencies are another factor causing constant instability in the running of corporations.Though this has of late been caused by other external factors such as exchange rates, amount of exports and imports and political factors. There has been a relatively high incidence of economic instability in the recent past. The national economies are recovering from a global economic meltdown today, most organizations have been negatively affected by the meltdown leading to massive layoffs. There are many more challenges that many companies and leaders encounter when managing.Diversity can help organizations compete in global markets by having a plan of other ventures that will bring new technology or and item to the market when a company has more than one option to make money successfully will make the chances of that company higher for them to succeed. or example lets look at Fuji film they diversified th ere company by making lcd screens and medical companies just to name a few things fuji film did to keep there companies head above water.An effective business strategy to address these challenges such as the change in technologies, generation gap, and unstable economies. The first step would be to build a good tech team that can stay on top of the technology an help keep the companies technology up to date. Then the generation gap a company hat has developed great ways to bring in new generations would be google they have done a many things to keep young talented employees to continue to come work for them for a few reasons they build a different environment that draws the new generation in.They also make the work environment more relaxing and stress free. A good way for a company to tackle this issue would be to listen to younger employees ideas and add some relaxing eliminates such as a gym, swimming pool or shona which employees could relieve stress before or after work. Then pre pare for the unstable economies there is a few things that can help with this first being diversifying the companies assets look into other business ventures easier said then dont also expand the company into different economies. A company that has multiple, unrelated businesses.Unrelated businesses are those which require unique management expertise, have different end customers and produce different products or provide different services. One of the benefits  of being a diversified company  is that it buffers a company from dramatic fluctuations in any one industry sector. But, if an individual perpetrates a criminal act, their culpability should be determined through a properly established process and a justified penalty must be given. Criminal law specifies the provision s for implementing procedures in criminal cases, lays down the groups sanctioned to perform these procedures, the kind of procedures and the outcomes of violating the prerequisites of the law. As specified by the Law on Criminal Procedure, one of these processes is the evaluation of witnesses.3 The notion of witness should be viewed from two perspectives. Firstly, the identity and character of the witness, and, secondly, the reason the witness is involved in the trial; in short, the focus of the witness’ evidence should be determined. Criminal law permits and mandates the pertinent groups to determine the accuracy of evidence so as to take appropriate actions or make judgments.4 Evidence can be verified through a variety of ways, such as interrogating of witnesses. The interrogation of witnesses is strongly governed by a chain of legal prerequisites verifying the identity and character of the witness, those who should not be allowed as witness, the duties and rights of a witn ess, the handling of witnesses by officials carrying out the procedures, the interrogation methods, the principles, the assessment of the capacity of the witness to testify, the methods to document evidence, and the outcomes of breaching the abovementioned prerequisites.5 Evidence from a witness is a statement by an individual who is not the focus of criminal procedures. The statement is given to the group carrying out the procedure which will exercise it to assess the evidence on account of which the judgment shall be given. For example, the statement can be raised by the court in passing judgment, the prosecutor when making a decision whether to impeach, and by the accused when petitioning against the charges.6 Hence, witnesses play a very important role in criminal cases. Their importance goes above legal systems and is not confined to a specific form of bureaucratic structure or stage in the growth of a legal system. Even though recognised in different periods and territories as a useful and justifiable ground in which to establish a criminal sentence, evidence given by witnesses has long been dealt with doubt. The game of volleyball Essay The object of the game of Volleyball is for each team to send the ball regularly over the net to ground it on the opponent’s court, and to prevent the ball from being grounded on its own court. Basic Outline of play: The player on the back right position serves the ball by hitting it over the net to the opponent’s court. A team is not allowed to hit the ball three times in attempt to return the ball to the opponent’s court. A player is not allowed to hit the ball twice consecutively, unless attempting to block the ball. The rally continues until the ball hits the ground/floor, goes out of bounds or a team fails to return it to the opponent’s court or commits a fault. Scoring Systems: The best of three or five games will win the match. The team that scores 25 points first with a minimum two-point advantage wins a game. If there is a deciding game, that game will be won by the team that first scores 15 points with a minimum two-point advantage. Side out Scoring: Side out scoring is another way to score a Volleyball match. The team serving is the only team that can score a point, except in the deciding game when rally-point scoring system is used. When the receiving team wins a rally, they gain the right to serve but do not gain a point and its players rotate one position clockwise. Rotation ensures that players play at both the net and the back zone of the court. A team wins a game by scoring 15 points with a two-point advantage. Further, they win the match by winning the best of three or five games. In the event of a 16-16 tie, the team that scores the 17th point wins a non-deciding game with only a one-point advantage. In a deciding game there is not point cap. The Basic Rules and Regulations of Volleyball: ========================================== ==== The Serve ( A ) Server must serve from behind the restraining line (end line)(refer to court diagram) until after contact. ( B ) Ball may be served underhand or overhand. ( C ) Ball must be clearly visible to opponents before serve. ( D ) Served ball must clear the net without touching the net. Failure results in a side out. ( E ) First game serve is determined by a volley, each subsequent game shall be served by the previous game loser. ( F ) Serve must be returned by a bump (dig) only. No setting or attacking a serve. A. a server must serve from behind the restraining line until after contact. B. The ball may be served underhanded or overhanded. C. ( E ) A legal hit is contact with the ball by a player body above and including the waist which does not allow the ball to visibly come to a rest. ( F ) If two or more players contact the ball simultaneously, it is considered one play and the players involved may not participate in the next play. ( G ) A player must not block or attack a serve. ( H ) Switching positions will be allowed only between front line players. (After the serve only). Basic Violations - ( A ) Stepping on or over the line on a serve. ( B ) Failure to serve the ball over the net successfully. ( C ) Hitting the ball illegally (Carrying, Palming, Throwing, etc. ). ( D ) Touches of the net with any part of the body while the ball is in play. If the ball is driven into the net with such force that it causes the net to contact an opposing player, no foul will be called, and the ball shall continue to be in play. ( E ) Reaching over the net, except under these conditions: 1 When executing a follow-through. 2 When blocking a ball which is in the opponents court but is being returned (the blocker must not contact the ball until after the opponent who is attempting to return the ball makes contact). Except to block the third play. ( F ) Reaches under the net (if it interferes with the ball or opposing player). ( G ) Failure to serve in the correct order. ( H ) Blocks or spikes from a position which is clearly not behind the 10-foot line (refer to court diagram) while in a back row position. The Court Playing Area Both indoor and outdoor courts are 18 m x 9mi (296 x 59). Indoor courts also include an attack area designated by a line 3 m (910) back from the center line. Lines on the court are 5cm (2 wide). Net Height Net height for men, co-ed mixed 6, outdoor is 2. 43 meters or 711-5/8. Net height for women, 74-1/8. The height of the net shall be 8. Ball The ball weighs between 9 and 10 ounces. Ball pressure is between 4. 5 and 6. 0 pounds Observation and Analysis For an analysis of the volleyball sport, we observed a 2 minute clip of a volleyball game between the red and green team. The 2 minute period revolved around the service of a player from the red team (6 serves were successfully executed before the opposition went for the kill which resulted in a side out). I observed each serve and detailed the plays of each team (red and green) for that particular serve.

Those who arent so hip to their Breaking Bad trivia may not have known the two were even related due to Saul (AKA Jimmy McGill) being a lawyer and the show itself being a darker legal drama as opposed to a prime time crime-fest. Okay, so theres still crime, but yeah, Better Call Saul was popular right away (it had the highest basic cable ratings in history when its first episode aired). Beverly Hills, 90210/ Melrose Place/ 90210/ Melrose Place (FOX) Beverly Hills, 90210 was a prime time teen drama that swirled around the oh-so-complicated lives of teens as they make their way through high school and college in one of the most affluent zip codes in the US. Grant Shows character, Jake Hanson, was introduced to the world via Kelly (Jenny Garth) in the original 90210s second season, and he lived at Melrose Place. Geared towards an audience of college kids and adults who could figuratively empathize with the trials and tribulations of attempting to make it in LA, Melrose Place featured stunning performances by Heather Locklear, Marcia Cross, and then teen heartthrob, Andrew Shue. Melrose Place and Beverly Hills,90210 were very successful and lasted seven and ten seasons respectively. However, the spin-offs 90210 (2008 for five seasons) and Melrose Place (2009 for one season) didnt fare as well, and ended up being nixed pretty quickly. Pawn Stars/ American Restoration/ Counting Cars/ Pawnography (History) Men all over the place who have watched Las Vegass family pawn shop reality series Pawn Stars probably already know this, but Counting Cars and American Restoration are both spin-offs of this antique-driven History Channel show. In fact, many episodes of Pawn Stars feature the head honchos of the two series when Rick enlists their services to provide appraisals of the various artifacts people bring into his familys shop. All three of the shows are still running on History along with a third Jeopardy ­-like show Pawnography that started this last year and gives people an opportunity to win some of the treasures in Ricks shop. Bones/ The Finder (FOX) Aired for a single season back in 2012 on FOX, The Finder was a spin-off of the wildly popular Bones, which is currently in its 10th season. The main character, Walter (played by Geoff Stults), was introduced to Bones fans back in the 6th season of the show, and was followed around in his work for the first and only season of the spin-off. It is also the last known work of infamous The Green Mile actor Michael Clarke Duncan who played Leo Knox in the fated series. Degrassi Junior High/ Degrassi High/ Degrassi: The Next Generation (CBC/ CTV/MTV/ PBS/ TeenNick) Centuries ago, Degrassi Junior High followed the lives of young teens in Toronto. The continuation of the series saw the kids in DJH go to high school for, you guessed it, Degrassi High. The next spin-off was geared towards high school students as an after school special. There were original cast members from the previous two spin-offs who participated in Degrassi Talks, but it ended up fizzling out, making brief appearances during sex-ed classes all over Canada in the late 90s. The biggest show came in 2001 as DJHs teen mom Spikes daughter, Emma (Miriam McDonald), became a teen herself. Degrassi: The Next Generation was a huge hit on both sides of the border and helped propel stars like Nina Dobrev and Drake into their current careers. With a modernized list of teen issues, the show is still big and in its fourteenth season. The Vampire Diaries/ The Originals (The CW) Although the supernatural drama The Vampire Diaries has been renewed for a seventh season on The CW, they spawned a spin-off that focuses on TVD character Niklaus Mikaelson (played by Joseph Morgan) who was introduced during the second season of the show. The show is called The Originals and set in New Orleans after almost 100 years of the Mikaelson clan being gone from the city and the pressures of being a vampires, werewolves, and witches, oh my! Crocodile Hunter/ Bindi the Jungle Girl (Animal Planet/Discovery Kids) Given the fact that Steve Irwin was fatally shot in the heart by a stingray while filming one of his documentaries about wildlife, some may not remember our beloved Crocodile Hunter so much. His legacy as an animal-lover and wildlife advocate has been carried on by his wife, Terry, and their children. One of these, Bindi Irwin, landed herself her own nature show that was geared towards children and aired on both Animal Planet and Discovery Kids. The show provided highly educational material for kids all over the world and featured Steve before his 2006 death but only lasted two seasons. Now 16 years old, she still works with animals, so watch out for Bindi in the future. Toddlers Tiaras/ Here Comes Honey Boo-Boo (TLC) As controversial as childrens pageants are, TLC felt that its 2009 series Toddlers Tiaras was popular enough to make a spin-off. Outspoken little one, Honey Boo-Boo, was given her own show Here Comes Honey Boo-Boo that aired in 2012 and went for four seasons. It was like a car accident with redneck trailer trash parents trying to raise their kids to be like mama and papa bear (or Mama June and Sugar Bear), complete with farts, belches, and some gross-ass substance lurking between Mama Junes toes. Eventually, Mama June landed herself in some hot water when she and her husband became estranged; Mama June later became romantically involved with a registered sex offender and child predator who quickly came to live with the family. The show was canceled because of it. -and there went Honey Boo-Boo. MadTV/ Key Peele (Comedy Central) The Comedy Central sketch show Key Peele is hilarious, and of course it is! The show is a spin-off of FOXs MadTV, their answer to SNL,which aired for fourteen seasons. The main stars of Key Peele are former MadTV cast members Jordan Peele and Keegan-Michael Key who often worked together in sketches and had an unmistakable chemistry as comedians. Key Peeles fifth season returns to Comedy Central later this year. The Daily Show/ The Nightly Show with Larry Wilmore / The Colbert Report (Comedy Central) Everyone has been talking about Trevor Noah replacing Jon Stewart as host of the long-running Comedy Central hit after his 16 years at the helm. Although its two spin-offs The Colbert report and The Nightly Show with Larry Wilmore are often misconstrued as copycats, Stephen Colbert and Larry Wilmore have The Daily Show and Jon Stewart to thank for their success as news satire and comedy anchors on their own respective shows. Now, all three are out there providing laughs and poking fun at the top news of the day in politics, pop culture, and much more. JAG/ The entire NCIS collection (CBS) Im not sure how many people out there watched JAG, but the Navy-themed legal drama somehow lasted for nine seasons on CBS. Once the show hit its eighth season, a few characters from NCIS were introduced to viewers, and the procedural drama has been going for thirteen of its own seasons and has resulted, much like its rival CSI, in additional spin-offs that set in New Orleans and Los Angeles. Good Morning, Miss Bliss/ Saved By the Bell (NBC) Technically a reboot of Disneys Good Morning, Miss Bliss, NBCs smash hit with teens in the early 90s was the birthplace of many Hollywood stars careers. Saved by the Bell differed from Good Morning, Miss Bliss in that it was set in High School rather than junior high. Saved by the Bell focused on the lives of students Kelly Kapowski, Screech, Zack Morris, et al. right through to college while GMMB was all about their teacher Miss Bliss. Saved by the Bell ran from 1989 to 1993 and was the American equivalent of Degrassi for tons of kids growing up in the 90s. However, the college spin-off and resurfaced teen series didnt do well with viewers or critics, so they were both canceled after giving them both a fair chance to succeed. Jackass/ Viva la Bam/ Wildboyz/ The Jackass Movies (MTV) The disgusting, funny, and very successful Jackass franchise has seen many spin-offs. The original series aired for three seasons on MTV between 2000 and 2002, and saw cast member Bam Margera break off to film his hectic life at home in Viva la Bam. The series was much like Jackass but definitely more raunchy and hardcore in terms of pranks and stunts, which were unleashed on his friends and family. Chris Pontius and Steve-O branched out too with their own show entitled Wildboyz where the two traveled the world, messed around with exotic animals and cultures while performing dangerous stunts on camera. Jackasss spin-offs are still their six films are the most successful. Two were considered bonus footage reels and were released as Jackass 2.5 and Jackass 3.5, and another was Academy Award-nominated Bad Grandpa. Although critics are never happy with them, and Ryan Dunn, one of the main cast members, passed away in a tragic car accident after Jackass 3Ds release, director Jeff Tremaine has hinted that there may be another film in the making, and it might go down in Australia. Chicago Fire/ Chicago P.D. (NBC) As if it wasnt completely obvious by the name, right? Well, some people dont know that the two Chicago-based prime time dramas were linked. Both are very successful with Chicago Fire currently in its third season and Chicago P.D. being renewed for its third season earlier this year on NBC. If you watch, you can see the characters interlocked during emergencies and investigations that require both law enforcement and fire. The Tracey Ullman Show/ The Simpsons (FOX) Hosted by former Brit pop star Tracey Ullman, The Tracey Ullman Show was FOXs second prime time show following in the footsteps of MarriedWith Children and featured a lot of comedy, animated shorts, and musical skits. The variety show was on for four seasons between 1987 and 1990. During the first two years of its broadcasts, the show featured shorts made by none other than Matt Groening, which happened to commonly feature everyones fave yellow family The Simpsons. The animation portion of the show was cut in 1989 so that it could try its luck in its own half hour slot, and there was The Simpsons. -and theyre still going after 26 seasons!

Comparing and contrasting two Poems on the theme of childhood Having read the four poems from Seamus Heaney's collection "Death of a Naturalist", I have decided to Compare and contrast the two poems that I like best, which are "Death of a naturalist" and "Follower". Both of these are childhood stories set in the countryside. These reflect how Heaney felt about different aspects of life in his surroundings. This is one of the reasons that I have chosen these two poems the idea of the countryside makes me feel at home with these two poems. They are both set in the open air, which creates an open atmosphere. "Death of a Naturalist" is the first poem I chose to write about because of the overall effectiveness of the poem. This poem has been written in paragraph like stanzas, this gives me the feel of making the poems look full of descriptions; it also looks very exiting looking at all the stanzas are crammed into one. As you look at the poem you can see effective use of vivid similes such as "Frogspawn grew like clotted Water" Frogspawn that grows like "clotted water" shows you the fullness of the frogspawn it also shows us that the frogspawn is racing and covering the pond water very fast it also gives me an impression that he enjoys seeing the frogspawn growing and covering the pond as he enjoys collecting frogspawn "I would fill jampotfuls of the jellied specs" This shows the enjoyment of a young child collecting and watching something grow. We see the use of positive phrases "There were dragon-flies, Spotted butterflies... " The use of commas and short sentences give us an understanding of the child's ... ...od jobs around the farm. The last lines in the poem make us think about what has happened to his father. "It is my father who keeps stumbling Behind me, and will not go away" the effect this creates by saying his father is weak and falling away behind him tells us that the roles have been reversed. After looking at these two poems many things are very similar in the way they have been written: the language and form are authentic language of farming by this I mean that the poems have got a use of old farm language an describe things in a farming form. Heaney also leaves the reader with a final line to think about. By reading the two poems Heaney now feels that it is time to break away from his past and he also feels different from his family. I think this because he is looking back and writing about the past and he is able to write about the future.

Nhat Ha Nguyen Michael Downs Hist November 27 2013 The Fiery Trial During and following the Civil War, Abraham Lincoln is widely known as the Great Emancipator. This title, however, has been the subject of much controversy, and many people believe he does not rightly deserve it. But there does not seem to be enough support for this argument, and there are many reasons why he should maintain the nickname. First of all, according to the book, the definition of Emancipate is to free from constraint or control. As a Great Emancipator, Abraham Lincoln completed his job excellently.During his serving time, Abraham Lincoln showed great political and moral courage. He eliminate the slavery issue from the arena of government. As he campaigned, multiple times, for the Presidency, he did not bend. He believed in freedom for all people, both black and white and bond and free. It is obvious that Lincolns environment bred some of the same prejudices against blacks that were common in the region of the United States into which he had been born and raised. These Lincoln comments should make the basis for a lively class discussion on Lincolns racial attitude. In addition to the influence of environment there is also the difficult question of Lincolns personality. Conflicting with opinions on how to deal with Civil War’s issues, laid many different factions in the United States. There are varying results on biographical work done on Lincoln. However, all biographers seem to agree that Lincoln was throughout his whole life a very moody person. On page 37 of The Fiery Trial, the author tells a story about how Lincoln stood oppose his father. Even on the last day on bed of his fat... ...2 and implemented in 1863. Although this Emancipation Proclamation is more about convincing the European nations not to help the south because this was a war to end slavery, and less about freeing southern slaves, however, Lincoln had good intentions on it. Though he wasn't alive when the 13th amendment was ratified, he helped create it. Lincoln played a part in the creation of it. His feelings on slavery changed during the war. In the beginning, he just wanted to stop spreading it, but in the end, he knew that he had to get rid of it. Lincoln emancipated not only the slaves. He emancipated all American citizens by reuniting our nation so that we could all live free today. There is no doubt that he deserves the title of â€Å"The Great Emancipator.† And like too many great men, Lincoln sealed his life’s work with his blood, dying as a martyr to the cause of freedom.

Graffiti as an Artform The value of any message or work of art, whether it is hanging on the wall of a gallery or a subway, lies on the intensity of the artist’s or vandal’s beliefs. Graffiti is an uncertain issue in respect to its virtue. While the voice of the individual must never be lost in a society of shouts growing larger and louder every second; graffiti is such a public medium that its integrity must be of great concern. Graffiti is a vast wasteland of indefinite opinions. Foremost graffiti is illegal and a form of vandalism, it invades peoples privacy and destroys their property. However, graffiti can be a means by which one may permanently express one’s self. It has the potential to convey a powerful, relevant message. Therefore the merit of graffiti is dependant on the circumstances present, how it affects society, and the purpose for which it is created. Graffiti serves several different purposes; it is a marker serving as proof of identity for some individuals, for others it is a form of vulgar recreation. The wall of one building may serve as a public record, a confessional and an art gallery at the same time. The most dejected application of graffiti is illustrated in the story of a High School student, Katy Lyle, who was emotionally traumatized by the presence of disgraceful, fictional writing transcribed on the wall of the boy’s bathroom pertaining to her sex life. This case clearly shows the damaging effects of graffiti as the crude remarks ripped her social life apart. The writing was completely void of worth, its intentions were to simply single out and destroy the individual to which it pertained. Case question: using the information in this chapter, how would you tell Jim to proceed? Using the information in the chapter, I agree with Jim O'Brien. Although getting large customers is important, making money is also important. Jim has a plan to require their customers to reduce loading and unloading times. If they cannot reduce their time, Harder Transportation has no choice but to either increase detention charges or consider dropping those customers. The sales organizations think these actions are against Harden's service strategy and they think some customers may even rebel.Some of Jim O'Brien largest customers have very long pick up and drop Off times. TO be successful Jim should make sure that their peddle run is correct. A peddle run is a route driven daily out of the pick up and drop off terminal to collect freight for outbound or inbound moves. Two elements of the peddle run is its stem time and peddle time. Stem time is the time that occurs when the driver leaves the te rminal until the driver makes the first pick up or delivery. Peddle time is the time during which drivers is actually involved in the pickup and delivery of freight.The wall would tell Jim O'Brien to proceed is he could go to the two driver system. While one driver is driving the other is in the sleeper berth of the tractor. The sleeper team has been very successful. Having more than one driver may even reduce to loading and unloading times. That is a great concern for Jim, because some of his largest customers have long pickup and drop off times. The sleeper teams also could potentially reduce driver fatigue and fewer accidents. They have new driving hours so it will help. The sleeper system would also reduce driving time.Another way Jim could proceed is he could compromise with his sales organization and his customers. Jim could make sure his peddle run is correct. Jim could compromise by reducing the stem time. If you decrease the stem time, you would increase the peddle time. Th e drivers would then spend less time driving. They would spend less time picking up and dropping off. The drivers would increase the productivity. Overall Jim O'Brien should do what is best for Harder Transportation. If some customers rebel then Jim is going to need new customers.

A Place You Would Like to Visit or to Live in

There are beautiful places all around the world. We all enjoy the Mother Nature. It is a gift to us. I would like to visit and travel all around the world, but the place which is most appealing to me personally is Coimbatore, which is in southern India. It is a beautiful place with scenic views. It is famous for textiles and textile machineries, so it is called the Manchester of South India.The reason I like Coimbatore is for its educational institutions, industries and climate.Firstly, the educational system is one of the best in the country. There are over 63 colleges and universities in and around Coimbatore. For example: Some of them including PSG group of institutions, Avinashilingam university are really good in imparting good education and offer various branches in the field of arts, engineering, medicine etc. To settle down in a place like this, we don’t have to be worried about my family’s education.Secondly, Coimbatore is a place with black soil on earth; cott on grows well in this soil. So the industries are based on this. Coimbatore is one of the largest producers of textiles. Business is done in small and large scale industries, this gives job opportunities for many people around the place.Thirdly, the weather in this place is awesome and satisfying experience. For example: for the most part of the year it is cool and pleasant. Unlike other parts of India this is bordered by western Ghats on the western side, which is one of the vital reason for this climate.

Are Grades and Effective Means of Motivation? Essay

Believing: Grades are often seen to be one of, if not the most effective method of motivating a student to work to their fullest potential. For example, a student who receives an A-grade is going to be encouraged by the grade, as they see it to be an affirmation of their academic efforts. An A-student views their grade with pride, and will work very hard to maintain said grade, once achieved. An example of this is as follows. John recently received an A on his Math test. He then goes home with a sense of pride, bragging about it to all of his friends. John now realizes that he must keep up the good work and continue to work hard for school, in order to continue to feel as good as he does today. Conversely, a failing student will regard his/her grades with shame, and will be more motivated to raise their grade from the gutter as a result. An example of this is as follows. John receives an F for failing to complete an assignment on time. As a reaction to this, John decides that he will turn his life around completely and alter his studying habits so that he turns in his assignments on time in the future. In conclusion, grades are by all means the most effective way of motivating a student to excel. Doubting: Grades are the least effective way of motivating a student. This can be said with such certainty due to the very nature of grades themselves. They serve to rank students against each other. Personally, when I feel as though somebody is putting me up against a friend, I feel much less willing to work harder for the class than if they were to simply tell me what I needed to change in order to excel. The Whitehall Study, performed in England 1967, has shown us with certainty that humans placed in a competitive hierarchical situation over prolonged periods of time will increase their chances of gaining cardiovascular disease by 40%. This shows us that students placed under similar conditions (as they are with the grade system) are not only less motivated to work, but are also at risk of dying. Another important factor to consider when discussing high-school students and their academic achievements is that many of us are apathetic. This means that when we see a grade, we simply just don’t care about it and it doesn’t serve to motivate us one way or the other. This leads me to conclude that grades, when seriously considered by the student, are not only the least effective way of motivating students to do their best work, but are also a serious health concern. Reflection: This writing activity was unlike anything I had seen before. It challenged me to write from two entirely different perspectives, which is something very new to me. The main difficulty I faced with this assignment was the assignment itself. While it may seem redundant to say so, the assignment asked us to write about something from two polarized perspectives, and that was what challenged me the most. I found it easy enough to write the doubting response, as it is what I can most easily associate with. When it came to writing the believing response, I felt as though I was stuck. I stared blankly at my page for several minutes until I finally decided to ask an A-student what their perspective on the matter was. Doing so helped me greatly, as it broadened my mind and aided me in writing about something from an entirely foreign perspective. After completing this assignment I can honestly say that I am a more well-rounded person, as I find it easier to relate to what others are saying, even if it goes against every fiber of my existence. Believing and doubting helps me wallow in complexity by reminding me not to forget that there is a flip-side to what I am arguing at any given time, and I’ve caught myself thinking about a few of my foundational beliefs and how they can be contradicted by somebody with a different outlook on life. In conclusion, I believe that this assignment has helped me to understand that there are several other points of view to consider.

In Babylonia flood story Ea the god of wisdom used Utnapishtim who was his favourite righteous man and he is the one who was warned and informed of the destruction through a dream. The meanings of the names although differ as Noah means â€Å"r est† while Utnapishtim means â€Å"finder of life†. None of the people used was faultless but, the gods considered them righteous compared to the people around them. Contract and Chou Essay The case scenario under review by our team includes a contract law situation involving a board game company and a game inventor. Big Time Toymaker (BTT) is a board game company which develops, manufactures, and distributes board games, and Chou is the name of the inventor of a new strategy game. In this scenario, what began with a payment made from BTT to Chou for exclusive negotiating rights for 90 days, ended in a change in management at BTT, leading to their company no longer having interest in distributing Chou’s game. Several questions will be asked about the validity of the terms agreed upon by the parties involved, including at what point did the parties have a contract, and what role does the statute of frauds play in this contract? Our objective is to analyze the case scenario, including the previously stated questions, and provide the answers to those and other questions pertaining to the scenario and contract law. Question 1 At what point, if ever, did the parties have a contract? There was mutual agreement between Chou and BTT via verbal agreement, and a subsequent email verifying that an agreement had been tentatively reached. According to the terms of distribution between Chou and BTT a contract was only valid if formalized in writing. An argument may be made that three days prior to the 90 day time limit a mutual agreement was reached and valid via an E-contract law. There was mutual assent between both Chou and BTT. The argument for the other side will state there was never a formalized written contract from either Chou or BTT, only an email with a subject heading stating Strat Deal. Is the email a valid contract? Question 2 What facts may weigh in favor of or against Chou in terms of parties’ objective intent to contract? The writing states that after months of no response from BTT and with no management in place the company no longer wishes to distribute Chou’s intellectual property. Seeing the email, Chou then assumed that this was the contract to be enforced and did not respond to BTT. Even though Chou received the email, he did not respond to it, thereby giving Chou the defense that silence is never acceptance. However, in E-contact law dictated by CA Civil Code 1624, b, 3, a, it says that online contracts are endorsable even if writing is required by the statute of frauds. The statutes of frauds do play a part in this contract due to the Uniform Commercial Code requiring that the statute of frauds applies to any contract for the sale of goods for $500 or more. However, the exact amount of â€Å"Strat† units that Big Time Toymaker (BTT) will sell or at what cost of each unit is unclear to the reader, it was described in detail in the email BTT sent to Chou. The new management at BTT cannot avoid this contract under the doctrine of mistake because a mistake was not made by both Chou and the old management team. The mistake by Chou was accepting the email outline of the contract terms as an actual contract agreed to by both parties. Scienter applies to Chou in this case by accepting a seemingly legitimate contract. Would either party have any other defenses that would allow the contract to be avoided? The change of management brought about individuals bound to the same company as the old management team was, therefore, scienter applies to the new management team in privity. The draft sent from Chou and received by BTT is a negotiable instrument. BTT thereby becomes a holder in due course. The inaction of BTT after the draft was sent is in violation of the UCC requirement that all offers are to be open for a reasonable period of 90 days. Chou was under the impression that a contract had been made before that 90 days had expired. Chou has real defense as well as personal defense due to breach of contract and fraud. Question 6 Assuming, arguendo, that this e-mail does constitute an agreement, what consideration supports this agreement? By law, statute of frauds would support this agreement. Due to the terms, there cannot be a lawsuit that can be upheld on particular contracts or arrangements, except if it is written and signed by the authorized party or representative. Under the statute, certain kinds of contracts have to be in writing in order to be enforceable in a court of law (Contracts: Statute of Frauds, 2013). The writing also has to be signed by the person who is held responsible for the contract or by that persons agent. To evade the justification of the Statute of Frauds, one would need to make sure the contracts are in text and signed by the other party; so, if the opposing party does not hold his or her end of the agreement, one would gain from that particular party. Question Assuming BTT and Chou have a contract, and BTT has breached the contract by not distributing the game, discuss what remedies might or might not apply. It is obvious BTT’s manager did not think clearly about protecting BTT from liability. He carelessly wrote the emails, and his careless actions put BTT at risk. This led Chou to believe that this e-mail was meant to replace the earlier notion that he should draft a contract. The compensatory damages for recovery Chou suffered by the non-breaching party would be the damages that would be awarded to the party in the same situation he would have been in if the other party had executed as agreed upon (Melvin, 2011). After review of the case scenario involving Big Time Toymaker and Chou the game inventor, we have concluded that not only was there a contract agreement between the parties, but that according to E-contract law, Chou may be bound by the terms included in the original email sent from BTT. In addition, the doctrine of mistake cannot be used in this situation because of scienter toward Chou and the old and new management of BTT. Several questions were asked of our team in accordance with contract law and the scenario provided by the textbook. This completes our analysis of the scenario and answers to the questions we were presented.
